1. Acceptance of Terms
By downloading, installing, or using the Roomly application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and Roomly Inc. ("Roomly," "we," "our," or "us").
2. Description of Service
Roomly is an AI-powered room design application that allows you to:
- Upload photos of rooms and transform them into different design styles using artificial intelligence
- Browse and discover interior design styles
- Save and organize your design transformations
- Share designs with the Roomly community and on social media
- Connect with Pinterest to import style preferences and save designs
- Discover products similar to items in your generated designs
3. Account Registration
To use certain features of the App, you must create an account. When creating an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your password
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
You must be at least 13 years old to create an account. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.
4. Subscription and Payments
4.1 Free Tier
The free tier includes limited transformations per month with watermarked outputs.
4.2 Premium Subscription
Premium subscriptions are available on a weekly or annual basis and provide unlimited transformations without watermarks, plus additional features.
4.3 Billing
- Payments are processed through Apple's App Store
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Refunds are handled according to Apple's refund policy
5. User Content
5.1 Your Content
You retain ownership of photos you upload and designs you create. By uploading content, you grant Roomly a non-exclusive, worldwide license to process, store, and display your content as necessary to provide the service.
5.2 Community Content
Content you share to the Roomly community is public. By posting, you grant Roomly and other users the right to view, share, and interact with your content.
5.3 Prohibited Content
You may not upload or share content that:
- Infringes intellectual property rights
- Contains nudity, violence, or hateful imagery
- Is illegal, fraudulent, or deceptive
- Harasses or threatens others
- Contains malware or harmful code
6. AI-Generated Content
Designs generated by our AI are created based on your input photos and selected styles. You understand that:
- AI outputs are generated and may not be perfect
- Designs are for visualization purposes and may not reflect exact real-world results
- We do not guarantee that products shown in "Shop the Look" will exactly match AI-generated designs
- You may use AI-generated designs for personal and commercial purposes, subject to these Terms
7. Pinterest Integration
If you connect your Pinterest account:
- You authorize us to access your Pinterest data as described in our Privacy Policy
- Your use of Pinterest features is also subject to Pinterest's Terms of Service
- You may disconnect Pinterest at any time in Settings
8. Community Guidelines
When using community features, you agree to:
- Be respectful to other users
- Not spam, harass, or bully others
- Not post misleading or false information
- Report inappropriate content
- Follow all applicable laws
We reserve the right to remove content and suspend accounts that violate these guidelines.
9. Intellectual Property
The Roomly app, including its design, features, and content (excluding user content), is owned by Roomly Inc. and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our written permission.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOMLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.
12. Indemnification
You agree to indemnify and hold harmless Roomly and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App, your content, or your violation of these Terms.
13. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the App ceases immediately.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance of the new Terms.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
